Casual loading究竟补偿了哪些权利? / What Rights Does Casual Loading Compensate For?

Casual loading is the higher rate paid to a casual employee, but it is not a cash purchase of every employment right. It principally responds to some entitlements and certainty that casuals usually do not receive.

Where does the loading rate come from?

Do not assume every job uses 25%. Check the applicable award, enterprise agreement, contract or national minimum wage order for the casual loading or specific casual rate. Also check whether weekend, public-holiday or overtime penalties combine with the loading or follow another formula.

Is the job genuinely casual?

The current definition is not determined by the contract label alone. At the start of employment there must be no firm advance commitment to ongoing work, and an entitlement to casual loading or a specific casual rate. The practical relationship, ability to accept or reject shifts, likelihood of future work and roster pattern can all be relevant.

Useful action: keep the Casual Employment Information Statement, use Fair Work’s PACT to check the award rate, and find where the payslip separately states—or says the hourly rate incorporates—the loading.
